2. Definitions
In these general terms and conditions, the following is understood to mean:
- Company: TryBeforeBuy
- Customer: any natural person or legal entity that enters into an agreement via the website
- Product(s): perfume samples / decants, filled from original perfume bottles
- Agreement: any purchase agreement between TryBeforeBuy and the customer
- Website: www.trybeforebuy.nl

3. Applicability
These general terms and conditions apply to all offers, orders, agreements, and deliveries of TryBeforeBuy.
The customer's general terms and conditions are expressly rejected.
If a provision proves to be void or voidable, the remaining provisions shall remain in full force and effect.

4. Offer, information and obvious errors
All information on the website has been compiled as carefully as possible.
Obvious errors, mistakes, or printing errors do not bind TryBeforeBuy.
Images, descriptions, and specifications are indicative and may differ from reality.

5. Nature of the products
TryBeforeBuy sells original perfumes in sample form (decants).
The products:
- are not from original retail packaging
- are intended for personal use
- are not official miniatures from perfume houses
Resale or commercial use is not permitted.

6. Scent experience and subjectivity
Scent perception is entirely subjective and depends on, among other things, skin type, pH value, body temperature, and environment.
Deviations in scent experience, intensity, or longevity do not constitute a defect and do not entitle the customer to dissolution or a refund.

7. Allergies and usage risks
Perfumes can contain substances that can cause allergic reactions.
The customer is personally responsible for the safe use and testing of products.
TryBeforeBuy accepts no liability for physical reactions, irritations, or consequential damage.

8. Conclusion of the agreement
An agreement is concluded as soon as:
- an order has been placed
- payment has been successfully completed
- an order confirmation has been sent by email
TryBeforeBuy reserves the right to refuse or cancel orders in case of misuse, fraud, or incorrect information.

9. Prices and payments
All prices are quoted in euros and include VAT, unless otherwise indicated.
Shipping costs are listed separately during checkout.
TryBeforeBuy reserves the right to change prices without prior notice.

10. Processing and shipping
TryBeforeBuy strives to process and ship orders as soon as possible, usually within a few business days.
Delivery times are indicative and do not constitute binding deadlines.

11. Shipping methods and conscious choice
The customer consciously chooses a shipping method:
- mailbox delivery without Track & Trace
- shipping with Track & Trace
The chosen shipping method is binding and implies acceptance of the associated risks.

12. Transfer of risk and loss
The risk of loss, damage, or delay passes to the customer at the moment of transfer to the carrier.
For shipments without Track & Trace, no investigation can be initiated and no compensation is due.

13. International shipping and customs
Customs fees, import duties, or taxes may be levied on international orders.
These costs are entirely at the customer's expense.
TryBeforeBuy is not liable for delays or additional costs due to customs procedures.

14. Right of withdrawal and hygiene exclusion
In accordance with Article 6:230p of the Dutch Civil Code, the right of withdrawal is excluded for products that are not suitable for return for hygienic reasons.
Opened or used perfume samples cannot be returned.

15. Complaints and reporting obligation
Complaints regarding damage, incorrect delivery, or missing products must be reported within 48 hours of receipt via info@trybeforebuy.nl, stating the order number and including clear photos.
In the event of late notification, any right to compensation lapses.

16. Limitation of liability
Any liability of TryBeforeBuy is limited to the amount of the relevant order.
TryBeforeBuy is not liable for indirect damages, consequential damages, lost profits, or intangible damages.

17. Force Majeure
Force majeure is understood to mean any circumstance beyond the control of TryBeforeBuy, including strikes, pandemics, transport disruptions, government measures, and extreme weather conditions.
During force majeure, obligations are suspended.

18. Intellectual property
All rights to texts, images, logos, and other content belong to TryBeforeBuy.
Third-party brand names are used solely for identification.

19. Privacy and data protection
Personal data is processed in accordance with the privacy and cookie policy and in compliance with the GDPR.

20. Amendments
TryBeforeBuy reserves the right to amend these general terms and conditions.
The most recent version always takes precedence.

21. Applicable law and disputes
All agreements and the use of this website are governed exclusively by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands.
